Landmark Strategic Litigation
Criminal Complaint Against HeidelbergCement Executives
Role: Lead Attorney
Conducted multi-year investigation and filed criminal complaint before the German Federal Public Prosecutor against senior HeidelbergCement executives for complicity in war crimes in the occupied Palestinian territory. This groundbreaking case targeted a major multinational corporation for its operations in illegal Israeli settlements and its exploitation of natural resources in occupied territory.
To the best of my knowledge, this is the first case arguing for the criminal responsibility of senior corporate executives in a parent company for failing to supervise criminal activity by their subordinates under a civilian superior responsibility framework.
La Fronterita Case - Argentina
Role: Author of amicus brief for Amnesty International
Submitted amicus brief to the Federal Court of Criminal Cassation of Argentina in Federal Prosecutor v. Minetti et al., a landmark criminal prosecution concerning corporate complicity in crimes against humanity during Argentina's military dictatorship.
The amicus brief argued that there has been significant adverse impact on the victims arising from the nearly 20 years of criminal proceedings, which amounts to an unjustified delay that may violate the victims' right to effective remedy. Shortly after the filing, the Argentinian court advanced the case to trial and proceedings remain ongoing.
Barrick Gold Case - Canada
Role: Contributor to amicus brief filed on behalf of Amnesty International
Submitted amicus brief to the Court of Appeal for Ontario in John et al. v. Barrick Gold Corporation. This case addresses corporate accountability for human rights abuses allegedly committed by security forces at Barrick Gold's Porgera mine in Papua New Guinea.
The amicus brief sought to overturn the early dismissal of the case at first instance by highlighting the importance of the right to effective remedy to the forum non conveniens analysis conducted by the lower court.
Anglo-American Mining Case - South Africa
Role: Author of amicus brief for Amnesty International and Southern Africa Litigation Centre (SALC)
Submitted amicus brief in Various parties Obo Minors v. Anglo-American South Africa Ltd. before the Supreme Court of Appeal of South Africa. This case concerns corporate accountability for environmental harm and health impacts on children living near mining operations.
Reports and Legal Analysis
Arms Transfers to Sudan Report
Reviewed and contributed to report for Amnesty International analyzing the transfer of arms used to commit international crimes during Sudan's civil war, examining the responsibility of corporations such as manufacturers, exporters, and importers under international law.
Unlawful Demolitions by Heavy Machinery Companies
Reviewed and contributed to reports and briefings on the use of heavy machinery to unlawfully demolish homes in the occupied Palestinian territory (OPT) and India, analyzing human rights responsibilities of equipment manufacturers and operators.
ICC Environmental Damage Policy
Submitted comments on behalf of Amnesty International on the ICC Office of the Prosecutor's Policy on Addressing Environmental Damage Through the Rome Statute. The comments provided input and recommendations on both the process and substance of the draft policy, including the importance of establishing a framework for investigating corporate actors potentially involved in environmental crimes.
